1. Introduction and Acceptance of Terms

By downloading, installing, or using the ListMucho mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Dumpster Hill, LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of Alabama, USA.

If you do not agree to these Terms, do not use the App.

2. Updates to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date and provide notice through the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

3. Description of Service

ListMucho is a flexible checklist application with intelligent product suggestions, budget tracking capabilities, and todo-list functionality. The App's core functionality operates offline and stores all lists and user data locally on the user's device. Optional cloud-based features are available for real-time list sharing, recipe sharing, and data backup.

Features include:
• Smart product search and suggestions
• Customizable display options for flexible use cases
• Budget tracking with tax calculations
• Offline operation with complete privacy
• Local storage of all lists and history
• Purchase history and shopping analytics

4. User Conduct and Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer or disassemble the App
• Use the App to violate any applicable laws or regulations
• Interfere with the App's functionality or security features

You are responsible for maintaining the accuracy of your lists and budget information.

5. Data Storage and Privacy

All lists, shopping history, and user data are stored locally on your device by default. The App's core functionality operates offline to protect your privacy. When you choose to use optional features such as list sharing, recipe sharing, or backup, limited data is temporarily transmitted to our secure cloud servers as described in our Privacy Policy (Available at https://listmucho.com/privacy.html).

6. Third-Party Advertising (Google AdMob)

ListMucho displays contextual grocery-related ads through Google AdMob. Google does not access your grocery lists or shopping data. Ads are served based on the app's category and your device settings, not your personal browsing history. However, if you have personalized ads enabled in your Google account settings, Google may show personalized ads beyond our request.

Google AdMob may collect limited data, including but not limited to:
• Device identifiers (e.g., Advertising ID on Android or IDFA on iOS, if permitted by your device settings)
• IP addresses (used for coarse location targeting and fraud prevention)
• Ad interaction data (e.g., clicks or views, used in an aggregated manner to measure ad performance)

This data is used to serve and measure advertisements and is governed by Google's Privacy Policy and AdSense Program Terms (applicable to AdMob). We do not control or have access to the data collected by Google AdMob.

Consent and Control: For users in regions like the EU, we use Google's User Messaging Platform to request consent for AdMob's data collection, as required by laws like GDPR. You may opt out of personalized ads via your device settings (e.g., disabling personalized ads on Android or limiting ad tracking on iOS) or by visiting Google's ad settings page. On iOS, we do not request App Tracking Transparency (ATT) consent because we do not track users across apps or websites.

Regional Compliance: We comply with applicable privacy laws, including GDPR and CCPA, by minimizing data collection and relying on Google AdMob's compliance mechanisms for advertising.

7. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING:
• Loss of lists due to device failure
• Any technical malfunctions or interruptions
• Inaccurate price calculations or budget tracking
• Any decisions based on App data

8. Termination

You may stop using the App at any time by uninstalling it from your device. All data stored locally remains under your control.

9. Governing Law

These Terms are governed by the laws of Alabama, USA. Any disputes shall be resolved through binding arbitration in Alabama, USA.
